Welcome to Selarati LLC (“Selarati,” “we,” “us,” or “our”). By visiting our website (www.selarati.com), registering for a trip, or using any of our services, you agree to these Terms & Conditions (“Terms”). Please review them carefully. If you do not agree, please do not use our website or participate in our services.
These Terms apply to all visitors, users, and participants of Selarati’s programs, including but not limited to A Koun Khmer Homecoming Experience.
1. Website Use & Content
1.1 Intellectual Property Rights
All content on this website and in Selarati’s marketing materials — including text, itineraries, images, videos, logos, and branding — is the property of Selarati LLC and protected under U.S. and international intellectual property laws.
You may not copy, reproduce, modify, or distribute Selarati’s content for commercial purposes or for creating a competing business without prior written permission.
Participants and community members are welcome to reshare Selarati’s social media content if they credit and tag @selarati. Any other use requires prior approval.
1.2 User Conduct
By using Selarati’s website and services, you agree to act lawfully and respectfully. Specifically, you agree not to:
Use the site or our services for fraudulent, unlawful, or unauthorized purposes;
Interfere with the website’s functionality, security, or accessibility;
Attempt to gain unauthorized access to Selarati’s systems or data;
Repurpose Selarati’s itineraries, content, or business model for competing ventures without written consent.
Selarati reserves the right to deny or revoke access to our website or services if these conditions are violated.
2. Non-Compete & Intellectual Property Protection
By participating in A Koun Khmer Homecoming Experience, travelers agree not to replicate, copy, or use Selarati’s itineraries, branding, or business model for a competing venture in Cambodia or Southeast Asia.
This non-compete agreement is valid for 5 years post-trip completion and applies to any activities in the tourism and travel sector.
Selarati LLC reserves all rights to its intellectual property, itineraries, designs, and content. Unauthorized use, duplication, or distribution is strictly prohibited.
3. Inclusions & Exclusions
What’s Included
Accommodations as listed in the itinerary
Select meals (e.g., welcome/farewell dinners and other meals noted in the itinerary)
In-country transportation between cities and sites
Group tours, activities, and cultural site entry fees as specified
Guided support from Selarati staff and local partners
What’s Not Included
International flights to/from Phnom Penh
Travel visas (participants are responsible for obtaining required visas)
Travel insurance (strongly recommended to cover medical emergencies, cancellations, and lost luggage)
Most meals and personal expenses not outlined in the itinerary
Each participant is responsible for arranging their own flights and securing all necessary travel documentation. Visa requirements vary depending on nationality, and participants should confirm the latest entry requirements with the Cambodian embassy or consulate prior to registering.
4. Booking, Payments & Deposits
A $500 deposit is required to secure your spot. Deposits are refundable until September 10, 2025, minus processing fees.
The remaining balance is due in two automatic installments (payment schedule outlined at registration).
Payment must be completed in full prior to departure. Failure to complete payments may result in cancellation of your booking.
5. Cancellation & Refunds
Cancellation by the Participant
On or before Sept 10, 2025: Deposit ($500) is refundable, minus processing fees.
Sept 11 – Oct 4, 2025 (60 days before trip): Deposit is non-refundable. Any additional payments made will be refunded, minus administrative and processing fees.
Oct 5 – Nov 3, 2025 (31–59 days before trip): 50% of the total trip cost will be forfeited. The remainder (if paid) will be refunded, minus administrative and processing fees.
Nov 4 – Dec 3, 2025 (30 days or less before trip): 100% of the total trip cost is non-refundable. No refunds will be issued.
No refunds are provided for no-shows, late arrivals, early departures, or unused services once the trip begins.
Cancellation by Selarati
Selarati reserves the right to cancel the trip due to force majeure, safety concerns, low participation, or other unforeseen circumstances.
If Selarati cancels due to low participation or other unforeseen circumstances that prevent the safe and reasonable operation of the trip, participants will receive a full refund of payments made to Selarati, less any administrative and transaction fees, OR may choose to transfer their booking to a future trip at no additional cost.
If Selarati cancels or modifies any trip due to circumstances beyond our reasonable control or a force majeure event (including but not limited to natural disasters, government restrictions, pandemics, political unrest), participants will be offered a credit toward a future Selarati trip. Selarati will make reasonable efforts to provide alternative arrangements or a credit toward a future trip. Cash refunds, if any, are at Selarati’s sole discretion and may be subject to deductions for unrecoverable costs already incurred..
Selarati is not liable for incidental costs such as flights, visas, or personal expenses.
Itinerary Changes & Modifications
While every effort is made to deliver the published itinerary, Selarati may modify or adjust itineraries, accommodations, or activities due to unforeseen circumstances such as:
Weather or natural disasters
Government regulations or travel restrictions
Health and safety concerns (e.g., outbreaks, emergencies)
Transportation delays or failures
Unavailability of accommodations or local providers
Local cultural events, holidays, or political circumstances
Selarati commits to ensuring any adjustments maintain the quality and integrity of the experience.
No refunds or reimbursements will be given for itinerary modifications.
Reasonable alternatives of equal or greater value will be provided when possible.
All refunds, where applicable, will be issued within 90 days and are subject to a $100 administrative fee in addition to any third-party processing costs.
6. Right to Refuse Service
Selarati LLC reserves the right to refuse service, deny participation, or remove a participant from a trip at any time, without refund, if they:
Engage in disruptive, aggressive, or unsafe behavior
Violate local laws, disrespect cultural norms, or disregard safety guidelines
Are intoxicated, under the influence of illegal substances, or behave inappropriately
Fail to disclose health conditions that could affect safe participation
Refuse to follow reasonable instructions from staff or guides
Engage in fraudulent activity (false identity, incomplete payments, attempts to scam the business)
We may also refuse future bookings from participants who violate these terms.
7. Traveler Responsibilities
Ensure you have a valid passport (valid for at least 6 months beyond trip dates).
Secure all necessary travel visas and travel insurance.
Provide accurate health and dietary information during registration.
Acknowledge that trip itineraries may be modified due to weather, government regulations, safety, or local conditions. No refunds will be given for itinerary adjustments, though Selarati will strive to provide equal or better value alternatives.
8. Assumption of Risk & Liability Waiver
By booking with Selarati, you acknowledge that travel carries inherent risks, including but not limited to transportation, weather, cultural differences, illness, or accidents.
Selarati LLC, its owner (Priscilla Kim Ong), and its affiliates shall not be held liable for any injury, illness, death, loss, damage, delay, or expense resulting from participation in the trip.
By registering, participants waive any claims against Selarati LLC, its owners, directors, staff, and partners, including claims arising from negligence, to the fullest extent permitted by law.
Selarati is not responsible for complications arising from pre-existing or undisclosed medical conditions.
Selarati requires all participants to have travel insurance covering medical evacuation, trip cancellation, and emergency care. Proof of insurance must be provided prior to departure. Participants without insurance assume full responsibility for all risks.
9. Media Release
By participating in A Koun Khmer Homecoming Experience, you grant Selarati LLC permission to use an irrevocable, perpetual, royalty-free license to use your likeness (photos, video, and audio recordings) taken during the trip for any media and promotional purposes worldwide (including social media, website, and marketing materials).
If you prefer not to be featured, you must notify Selarati in writing prior to the trip.
10. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of New Hampshire, USA, without regard to conflict of law principles.
Any dispute shall be resolved through binding arbitration in New Hampshire, under the rules of the American Arbitration Association.
11. Changes to Terms
Selarati LLC reserves the right to update these Terms & Conditions at any time. Updates will be posted on our website, and continued participation in Selarati programs constitutes acceptance of the updated Terms.
